Terms and Conditions

Introduction


1. **Purpose**: These terms and conditions are designed to outline the agreement between [The Practice of David G Parsons MRCVS], hereafter referred to as “the Practice,” and its clients. They are intended to ensure a clear understanding of the services provided and the responsibilities of both parties.
2. **Acceptance**: By registering your pigeons with the Practice or using our services, you are agreeing to these terms and conditions.

Services and Appointments


1. **Service Provision**: The Practice provides veterinary services specifically relating to the requirements for pigeon owners to move their pigeons to the EU or Northern Ireland for immediate release. The practice does not offer telephone consultations,  consultancy on pigeon ailments,  surgical procedures, the dispensing of medications or laboratory diagnostic services.

2. **Opening Times**: The Practice is open 3 days a week. The days worked are variable depending on the visit schedule.
3. **Loft visits**: Loft visits should be organised as part of a group. A deposit may be required. Loft visits will only be undertaken provided the requisite on-line forms have been completed 7 days prior to the date of the proposed visit.

4. **Loft visit and Practice Registration**: This is valid for 1 year commencing from the date of the Loft visit.
5. **Cancellation Policy**: If you need to cancel a loft visit, please provide at least 72 hours’ notice. Failure to do so may result in a cancellation fee.

Fees and Payments


1. **Fees**: The Practice’s fees are subject to change. You will be informed of the cost of a loft visit before it is provided.
2. **Payment Terms**: Payment is due 7 days before the visit. Payment may be made as a group through the regional organiser or individually. The Practice accepts payment by bank transfer, details will be provided on the loft visit forms.

Client Responsibilities


1. **Pigeon Care and Safety**: It is the owner’s responsibility to ensure their pigeon’s safety during the loft visit.
2. **Information Accuracy**: Owners must demonstrate that they have registered their pigeons to move to the EU and Northern Ireland for immediate release, have completed the “Racing pigeon establishment operator declaration for the movement of racing pigeons to the EU or Northern Ireland for immediate release for racing back to Great Britain” and have Pigeon paramyxovirus vaccination certificates listing the unique closed ring number for all their pigeons using an authorised vaccine. These records need to be kept for a minimum of 3 years.

3. **Cancellation of Loft Visits**: Failure to notify the Practice that a loft visit is not required or cancellation within 72 hours of the due date will remove the owner from the Practice register. Registration for the following year is not automatic.

4. **Compliance with the Animal Welfare Act 2006**: The Act brings together and updates legislation that exists to promote the welfare of vertebrate animals, other than those in the wild. In particular, The Five Freedoms ensure that the mental and physical needs of pigeons in our care:

  1. Freedom from hunger and thirst
  2. Freedom from discomfort
  3. Freedom from pain, injury, or disease
  4. Freedom to express normal behaviour
  5. Freedom from fear and distress

5. **Inappropriate remarks and behaviour**: These will not be tolerated and may result in the owner being removed from the Practice register.

6. **Smoking or Vaping**: It would be appreciated if owners do not smoke or vape during the visit.

7. **Alterations to Practice documents**: No alterations to Practice documents are permitted.

Data Protection and Confidentiality


1. **Data Protection**: The Practice complies with the [Data Protection Act/Equivalent Legislation] and will only use your personal data for the purposes of providing veterinary care and services.
2. **Confidentiality**: The Practice maintains the confidentiality of all client and patient information.

Liability and Indemnity

1. **Liability**: The Practice will not be liable for any damages or losses resulting from the provision of veterinary services, except to the extent that such damages or losses are caused by the negligence of the Practice.
2. **Indemnity**: Clients agree to indemnify the Practice against any claims, damages, or expenses arising from the client’s breach of these terms and conditions.

Governing Law and Jurisdiction

1. **Governing Law**: These terms and conditions shall be governed by and construed in accordance with the laws of Great Britain.
2. **Jurisdiction**: Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Great Britain.

Changes to Terms and Conditions

1. **Amendments**: The Practice reserves the right to amend these terms and conditions at any time without prior notice.
2. **Notification**: Changes will be posted on the Practice’s website, and it is the client’s responsibility to review these terms and conditions regularly.
